Privacy Notice

This notice explains how Level Method LLC ("Level Method," "we," "us" or "our") collects, uses and shares personal information when you visit https://www.levelmethod.com, use our web and mobile applications, or deal with us in sales, marketing, support or events (together, the "Services"). If you have questions, contact support@levelmethod.com. If you do not agree with this notice, please do not use the Services. If you live in Washington or Nevada, our Consumer Health Data Privacy Policy also applies.
Our two roles
Where we decide how information is used (controller). For gym owner, coach and staff accounts, gym subscriptions and billing, our website, marketing and sales, support you ask us for, and our own consumer products such as the Level Method Individual app, we decide why and how personal information is used. This notice describes that processing.
Where a gym decides (processor). When a gym uses Level Method to manage its members' profiles, assessments, levels, workouts and Success Plans, the gym decides the purposes, holds the lawful basis and gives its members its own notice. We process those gym-managed records only to provide the service on the gym's instructions, under our Terms of Service and the Privacy Addendum the gym accepts. Gym-managed records can include names, email addresses, phone numbers, dates of birth, gender, profile images, membership and staff roles, assessment results and history, workout records, body measurements, goals, coaching notes and Success Plan images, depending on the features used; notes, results and images may reveal health information. We do not sell gym-managed records or use them for advertising. If you are a gym member with a question or request about your records, contact your gym or ask us to route your request.
Anonymous workout information. On a gym's instruction we may prepare anonymous information from structured workout and assessment records (movements, loads, repetitions, times, scaling choices and level bands), never from notes, images or health fields, and use it, pooled across gyms, to test, improve and train our workout-scaling services. We prepare it so that it no longer identifies anyone by reasonably likely means, use it only in that form, do not attempt to identify anyone from it except to test our method, and require by contract that anyone who receives it does the same.
Gym owners accept the Privacy Addendum when they sign their license or from the account page in the Level Method app. For a copy, or for provider and international transfer information, contact support@levelmethod.com.
1. What information we collect
Information you give us. Names, email addresses, phone numbers, passwords and similar account details; billing and business details when you buy a service; the standards you select, your bodyweight, your answers and the predicted level when you use the Level Predictor; and, when you use our free analysis form, your answers, which can include training history, body measurements, injuries and health screening answers, so that we can prepare your analysis and a coach can contact you. The information you give us must be accurate, and you must tell us of changes.
Information collected automatically. When you use the Services we collect log, device and usage information such as IP address, browser and device characteristics, operating system, language, referring URLs, approximate location derived from IP address, the pages and features you use, timestamps and error reports. We use it to keep the Services secure and working and for internal analytics.
Third-party sign-in. Where we offer sign-in with a third-party account such as Apple, we receive the profile information that provider shares for that purpose, typically your name, your email address or a relay address, and an account identifier. We use it only as this notice describes. The provider's own privacy notice governs its use of your information.
2. How we use your information
We use the information we collect to:
- create and manage your account and sign you in, including with a third-party account
- provide the Services you ask for, including the Level Predictor and free analysis, and associate a Level Predictor result with a later Individual registration that uses the same email address
- fulfill and manage orders, subscriptions and payments
- respond to your inquiries and give you support
- send administrative information about the Services and changes to our terms and policies
- send marketing communications, which you can opt out of at any time (section 8)
- on our public website and in our own marketing, show personalized content and advertising and measure it, including through third parties; gym-managed records are not used for this
- post testimonials, with your consent to use your name and the content
- request feedback, and run prize draws and competitions you enter
- keep the Services safe and secure, enforce our terms, respond to legal requests and prevent harm
3. Who we share it with
We use providers to run the Services: application and database hosting, file storage, email and text-message delivery, payment processing, support, diagnostics, customer relationship management and marketing automation for gym owner and prospect records, and gym-management integrations a gym connects to its account (such as Chalk It Pro). Providers process information for their functions; for example, delivering a member email involves the recipient address and message content. Some features involve additional providers when used, such as audio transcription or message preparation. Contact support@levelmethod.com for the providers relevant to you or your gym. We and our providers process personal information in the United States, where privacy law may differ from yours.
A gym can connect developer apps to its account through our Developer API, in which case we share the gym's data with the developer on the gym's instruction under our Developer API terms, and the developer's own notices govern its use of that data.
We may also disclose information to comply with law, a court order or a lawful request; to investigate or act on suspected fraud, violations of our policies or threats to anyone's safety; as evidence in litigation; to our affiliates, who must honor this notice; and in connection with a merger, sale of assets, financing or acquisition of all or part of our business.
4. Cookies and tracking technologies
We use cookies and similar technologies for sign-in, security and preferences, and for analytics with Google Analytics, which receives no names, email addresses or account identifiers. On our public website we also use the Meta Pixel and our own referral cookies to measure advertising, limited to page views, clicks to start a trial and purchases. If you are in the EU/EEA, the United Kingdom or Switzerland, we ask first: until you accept, Google receives only cookieless signals and the Meta Pixel and referral cookies are not used. Elsewhere they are on by default. Google and Meta may collect information about your activity on our website and on other sites for those purposes. You can change your choice with Cookie settings in the website footer. You can refuse or delete cookies in your browser settings; some features may then not work. To opt out of interest-based advertising, visit http://www.aboutads.info/choices/.
5. How long we keep it
We keep personal information for as long as needed for the purposes in this notice, then delete or anonymize it, unless a longer period is required or permitted by law (for example tax, accounting and legal-claims periods), by our agreements with gym customers, or to keep evidence of an agreement you or your gym signed. Records of privacy requests are kept for at least 24 months where the CCPA requires. Gym-managed records are kept for as long as the gym's instructions and our agreement with the gym require. Deleted information may remain for up to six months in encrypted backups that are used only for disaster recovery, are not otherwise accessed and are overwritten on schedule; if we restore a backup, we re-apply deletions.
6. Security
We maintain technical and organizational security measures designed to protect personal information. No transmission over the Internet or storage technology can be guaranteed to be secure, so we cannot promise that unauthorized third parties will never defeat our security.
7. Minors
Our websites and our own consumer products are for adults, and the Level Method Individual app requires you to be 18 or older. We do not knowingly collect personal information from children under 13 for our own purposes; if we learn that we have, we delete it. A gym may enroll younger members in the gym service; the gym is responsible for any parental authorization those members need, and we process their records only on the gym's instructions. If you believe we hold a child's information without the required authorization, contact support@levelmethod.com.
8. Your choices and requests
Your account. To review, change or close your account, email support@levelmethod.com. When you close your account we deactivate or delete it from our active databases, but may keep some information to prevent fraud, resolve problems, assist investigations, enforce our terms or meet legal requirements.
Marketing email. Unsubscribe with the link in any marketing email or by emailing support@levelmethod.com. We may still send service messages needed to administer your account.
Requests about your data. To request access, a copy, correction, deletion, restriction, objection, or an appeal where available, email support@levelmethod.com; you do not need to cite a law. For records your gym controls, contact the gym or ask us to route your request. Account closure and deletion require separate consideration of other gym memberships, billing obligations, backups and legally required records; a request receipt is not confirmation of completed erasure.
9. If you are in the EEA, the United Kingdom or Switzerland
This section applies where we act as controller, for example for Level Method Individual app users, gym owner and staff accounts, website visitors and people who contact us. For records your gym controls, the gym is the controller and our Privacy Addendum with the gym governs our processing; ask your gym for a copy.
Purposes and legal bases. We process personal information:
- to create your account, deliver and bill the Services you buy, and give you support: performance of our contract with you
- to keep the Services secure, improve them, and communicate with gym owners and prospective customers about our business: our legitimate interests in running and protecting our business, balanced against your interests and rights
- to send marketing you opt into, to set optional cookies, and to use health-related answers you choose to give us (for example, in a health screening or the analysis form): your consent, which you can withdraw at any time without affecting earlier processing
- to keep tax and accounting records and respond to lawful requests: our legal obligations
We do not make decisions about you based solely on automated processing that produce legal or similarly significant effects.
Processing in the United States. We are based in the United States and process personal information there, where privacy law differs from your country's. When you create an account, buy a service or contact us from the EEA, the UK or Switzerland, you provide your information directly to us in the United States, and we protect it as this notice describes. For gym member records, the Privacy Addendum incorporates the European Commission's Standard Contractual Clauses and, for the UK, the Information Commissioner's Addendum.
Retention. Section 5 explains how long we keep information.
Your rights. You may ask for access to your personal information and a copy of it, correction, erasure, restriction of processing, portability, and to object to processing based on our legitimate interests, including direct marketing. To exercise a right, email support@levelmethod.com; we may need to verify your identity. You also have the right to complain to a supervisory authority, in particular in the EEA country where you live or work (list of authorities), to the UK Information Commissioner (ico.org.uk) or to the Swiss Federal Data Protection and Information Commissioner (edoeb.admin.ch).
Whether you must provide information. Account and billing information is needed to enter into and perform our contract with you; without it we cannot provide the Services. Other information is optional unless a feature says it needs it.
Contact. Our privacy contact is in section 13.
10. Do Not Track
Our public website does not load its analytics and advertising scripts when your browser sends a Do-Not-Track signal. We do not currently respond to other opt-out preference signals, such as Global Privacy Control; if that changes, we will say so in a revised notice.
11. California residents
Shine the Light. California Civil Code Section 1798.83 lets California residents request, once a year and free of charge, information about personal information we disclosed to third parties for their direct marketing purposes in the preceding calendar year. Email support@levelmethod.com.
Under 18. If you are under 18, live in California and have an account, you may ask us to remove content you posted publicly on the Services. Email support@levelmethod.com with your account email and a statement that you live in California. Removal may not be complete in every system, such as backups.
Categories of personal information. The categories below describe what the Services can process depending on the features used; not every category is collected about every person. Identifiers (names, email addresses, phone numbers, account and membership identifiers, IP addresses, business mailing details); profile characteristics (gender and date of birth when supplied); commercial information (subscription, payment and purchase records); internet or network activity (usage, diagnostics and website interactions); images and audio (profile and Success Plan images, audio or other uploads); business contact information (gym contacts, staff roles, a signer's title); fitness records and inferences (assessment results, levels, predicted levels, goals, coaching notes and plans, which may reveal health information); and support and request records. We may also collect other information when you contact support, take part in surveys or contests, or interact with us in person, by phone or by mail.
Use, disclosure and sale. We use and disclose these categories for the purposes in this notice and disclose them to service providers that process them on our behalf. We do not sell personal information, gym member records or email lists. Website analytics and advertising technology are described in section 4; this statement does not claim they are exempt from applicable consent or opt-out requirements. Where permitted, we may use personal information for internal research and development; the workout-scaling permission described above covers only non-personal or lawfully anonymized information.
Your rights. Where the CCPA applies, you may ask us to disclose the categories and specific pieces of personal information we collect and the sources, purposes and third parties involved; to delete your personal information, subject to legal exceptions; to correct inaccurate information; and to stop any sale or sharing of it as those terms are defined by law. We will not discriminate against you for exercising these rights. We are not required to re-identify de-identified information to respond to a request.
Verification and authorized agents. We verify requests by matching the information you give us with information we hold, or by contacting you through a method you previously provided, and use that information only for verification; we delete extra verification information as soon as practical after the request, except for the request records we must keep. An authorized agent must show proof of authorization, or we may deny the request.
12. Changes to this notice
We may update this notice; the "Last updated" date shows the current version, which applies as soon as it is posted. If we make material changes, we may post a notice or contact you directly.
